Arti91黑料爆料 I. Membership

Membership classes of the South Caro颅li颅na Bar are defined by Rule 410 (h), SCACR:鈥圧egular, Inactive, Judicial, Judicial Staff, Military, Administrative Law Judge or Workers' Compensation Commission, Retired, Limited Member - Rule 405, Limited Member - Rule 414, Limited Member - Rule 415, Limited Member - Rule 427 and Military Spouse Attorney - Rule 430. Mem颅ber颅ship sta颅tus is de颅ter颅mined as of Jan颅u颅ary 1 each year. A member may change class as set forth in Rule 410, SCACR.

(a) The annual license fees are set forth in Rule 410(j), SCACR.

(b) Retired mem颅bers shall by February 1 notify the Bar through the Attorney Information System or otherwise in writing of the member's then current address whether or not there has been a change.

(c) License fees are due and pay颅able on the first day of January. Per颅sons who become members of the Bar after the first day of Jan颅u颅ary but be颅fore the first day of July shall pay on or before July 1 the fees specified under Rule 410(n).

(d) Any member who fails to pay the required license fee on or before January 31 shall be assessed a penalty as set forth in Rule 410(m). If a member pays before February 1 and that check is returned to the Bar after January 31 for any reason, the same penalty will be assessed.

(e) Administrative suspensions shall be governed by Rule 419, SCACR.

(a) The Attorney Information System shall be the source of enrollment information for members.

(b) The Board of Governors shall prescribe such additional information which shall be collected upon enrollment.

(c) The mailing and email address appearing on the Attorney Information System shall be the official address of the member for all purposes of the Bar including the giving of notice and for the purpose of eligibility to vote and election to office.

(a) Regular members, judicial staff members and limited license mem颅bers admitted under Rule 405 and Rule 414, while in good standing as defined in Rule 410(i), SCACR, shall be el颅i颅gi颅ble鈥

(1) to vote in the election of or serve as a member of the Board of Governors or as a circuit del颅e颅gate in the House of Del颅e颅gates;
(2) to vote on any matter before the As颅sem颅bly or on any matter which is the subject of a ref颅er颅en颅dum di颅rect颅ed to the mem颅ber颅ship; and
(3) to serve as voting members of com颅mit颅tees, boards, task forces, commissions, divisions and sections.


(b) Judicial members, military members, administrative law judge or workers' compensation commission members and military spouse attorney members, while in good standing as defined in Rule 410(i), SCACR, are entitled鈥

(1) to attend meetings of the As颅sem颅bly and to participate with颅out vote in its de颅lib颅er颅a颅tions;
(2) to serve as nonvoting mem颅bers of com颅mit颅tees, boards, task forces, commissions, divisions and sections; and
(3) to receive all notices and pub颅li颅ca颅tions of the Bar except no颅tic颅es re颅lat颅ing to elec颅tions and mat颅ters upon which only regular mem颅bers may act.

(c) Inactive members, limited license members admitted under Rule 415 and Rule 427, and retired mem颅bers, while in good standing as defined in Rule 410(i), SCACR, shall have the same privileges as do judicial mem颅bers except that they shall not be en颅ti颅tled to receive any notices or pub颅li颅ca颅tions except SC Law颅yer un颅less they shall request the Sec颅re颅tary in writing that they be sent the other notices to which ju颅di颅cial mem颅bers are en颅ti颅tled.

Arti91黑料爆料 II. Circuit Delegates; Out of State Delegates; At Large Delegates

Delegates from odd-num颅bered cir颅cuits shall be elected in even-num颅bered years and del颅e颅gates from even-num颅bered cir颅cuits shall be elect颅ed in odd-num颅bered years. On or before the fif颅teenth day of January, ten or more regular mem颅bers re颅sid颅ing in the circuit from which one or more del颅e颅gates are to be elected may file with the Board of Gov颅er颅nors, which shall serve as a board of elec颅tors, a signed pe颅ti颅tion nom颅i颅nat颅ing a can颅di颅date, or can颅di颅dates, for cir颅cuit del颅e颅gate from that cir颅cuit.

The Board of Gov颅er颅nors shall there颅upon cause the name of each nom颅i颅nee to be pub颅lished or oth颅er颅wise dis颅trib颅ut颅ed to all mem颅bers. If the num颅ber of per颅sons nom颅i颅nat颅ed does not exceed the num颅ber of del颅e颅gates to be elect颅ed from a circuit, the Board of Gov颅er颅nors shall declare the nom颅i颅nees elect颅ed. If few颅er per颅sons are nom颅i颅nat颅ed than there are del颅e颅gates to be elect颅ed, the Board of Gov颅er颅nors shall choose a suf颅fi颅cient num颅ber of nom颅i颅nees to con颅sti颅tute a full slate.

If the num颅ber of nom颅i颅nees exceeds the num颅ber of del颅e颅gates to be elect颅ed from a cir颅cuit, the Board of Gov颅er颅nors shall on or before the fif颅teenth day of Feb颅ru颅ary pre颅pare bal颅lots bear颅ing the names of the nom颅i颅nees and shall cause a ballot to be distributed to each regular member, judicial staff member, limited member - Rule 405 and limited member - Rule 414 mem颅ber re颅sid颅ing in such cir颅cuit. In order to be ef颅fec颅tive, each ballot shall be duly marked and returned to the Board of Gov颅er颅nors not later than the fif颅teenth day of March.聽

On that date the bal颅lot颅ing for the elec颅tion of circuit del颅e颅gates shall be closed and the Board of Governors shall pro颅ceed to count the bal颅lots and de颅ter颅mine, an颅nounce, and pub颅lish the results of such elec颅tion. Where there is only one circuit del颅e颅gate to be elect颅ed from a ju颅di颅cial cir颅cuit, the nom颅i颅nee receiving the great颅est num颅ber of votes shall be declared. Where there are more than one cir颅cuit del颅e颅gate to be elect颅ed from a ju颅di颅cial cir颅cuit, those nom颅i颅nees receiv颅ing the great颅est num颅ber of votes shall be de颅clared elect颅ed until all po颅si颅tions are filled. In the event of a tie vote, the Board of Gov颅er颅nors shall de颅clare the pro颅ce颅dure to be fol颅lowed to de颅ter颅mine the nom颅i颅nee or nom颅i颅nees elect颅ed.

The out-of-state delegates shall be elected in even num颅bered years to serve for a term of two years. Nom颅i颅na颅tions for out-of-state del颅e颅gates may be made by petitions signed by ten or more regular members who reside either 颅within or without the state of South Caro颅li颅na. Ballots for out-of-state del颅e颅gates shall be sent to and cast by only regular mem颅bers who re颅side without the state.
The provision of Section 2.1 re颅lat颅ing to the nomination and elec颅tion of cir颅cuit del颅e颅gates shall apply to the nom颅i颅na颅tion and elec颅tion of the out-of-state del颅e颅gates ex颅cept insofar as such pro颅vi颅sions are in conflict with the pro颅vi颅sions of this Sec颅tion 2.2.

After the election of Circuit Delegates the Board of Governors shall elect two at large delegates from counties not represented by the newly elected circuit delegates. Delegates from odd-numbered circuits shall be elected in even-numbered years, and delegates from even-numbered circuits shall be elected in odd-numbered years.

In the event of a vacancy in the position of 颅circuit, out-of-state delegate or at large delegate, the Board of Gov颅er颅nors shall fill the va颅can颅cy for the remain颅der of the un颅ex颅pired term. A vacan颅cy occurs when a member is no long颅er a regular mem颅ber, the mem颅ber鈥檚 res颅i颅dence chang颅es to anoth颅er circuit or an at large delegate鈥檚 residence changes to another county.

The pro颅gram at all meetings of the Bar shall be supervised by the Board of Gov颅er颅nors.

No mem颅ber shall, in discussion or de颅bate at meet颅ings of the As颅sem颅bly or the House of Del颅e颅gates, speak more than ten min颅utes at a time or more than twice on one subject.

At any meeting of the As颅sem颅bly or the House of Del颅e颅gates dis颅tin颅guished guests may, on motion duly passed, be ex颅tend颅ed the priv颅i颅leg颅es of the floor.

Rob颅erts Rules of Order shall govern all meet颅ings of the As颅sem颅bly and the House of Delegates ex颅cept as is oth颅er颅wise pro颅vid颅ed in the Con颅sti颅tu颅tion and these Bylaws.

Amendments proposed to matters before the Assembly or House of Delegates shall be submitted in writing to the person presiding over the 颅meeting on the proposal.

The Lawyer鈥檚 Oath and the South Carolina Rules of Professional Conduct shall be an essential part of and govern the decorum that is to take place in a House of Delegates meeting along with Robert鈥檚 Rules of Order. During debate, members of the House must maintain professionalism. In debate, members must confine themselves to the question before the House of Delegates and avoid personal attacks or denigration. The officers of the House of Delegates should always be referred to by their official titles. It is not allowable to denounce the motives of a member by name. During debate, while the Chair is speaking, or the House of Delegates is engaged in voting, no member is permitted to disturb the meeting.

Should a member violate Section 3.6 above, the member may be removed for the remainder of the meeting by a motion approved by two-thirds of the members聽attending the meeting.

(a) A resolution which is offered to the Assembly shall be in writing, con颅cise, and, including its pre颅am颅ble, lim颅it颅ed to no more than three hun颅dred words. If it sup颅ports or op颅pos颅es ex颅ist颅ing or pro颅posed leg颅is颅la颅tion, it shall be accom颅pa颅nied by a copy of the 颅measure con颅cerned or by a sum颅ma颅ry of its pro颅vi颅sions.

(b) Between meetings, a res颅o颅lu颅tion may be filed with the Sec颅re颅tary. Dur颅ing a meet颅ing, a res颅o颅lu颅tion may be offered only at the first session of the As颅sem颅bly.

Neither the As颅sem颅bly, the House of Delegates, nor any com颅mit颅tee, sec颅tion, division, task force, board or com颅mis颅sion shall con颅sid颅er a res颅o颅lu颅tion com颅pli颅men颅ta颅ry to an of颅fic颅er or mem颅ber. The Board of Gov颅er颅nors may, how颅ev颅er, make an award or grant a ci颅ta颅tion to an officer or mem颅ber or other per颅son for ser颅vic颅es per颅formed, a pa颅per read, or an ad颅dress de颅liv颅ered. The Board may approve criteria by which a committee, division or section may recognize such person.

Only 颅resolu颅tions which have been adopt颅ed by the As颅sem颅bly need to be pub颅lished in the pro颅ceed颅ing of the meet颅ing.

Arti91黑料爆料 V. Reports and Recommendations

The Board of Gov颅er颅nors shall trans颅mit to the House of Del颅e颅gates, in the manner pre颅scribed by the House, the re颅ports of di颅vi颅sions, sections, com颅mit颅tees, boards, task forces, and com颅mis颅sions with any rec颅om颅men颅dations or com颅ments which the Board may have. The Board may also have such re颅ports placed on the cal颅en颅dar of the As颅sem颅bly.

A re颅port or rec颅om颅men颅da颅tion of a division, section, com颅mit颅tee, board, task force, or commission becomes the action of the Bar only if it is ap颅proved by the House of Del颅e颅gates or the Board of Gover颅nors.

Arti91黑料爆料 VI. Representation of the Bar

The Pres颅i颅dent or his designee shall ex颅press the policy of the Bar as de颅ter颅mined by the House of Del颅e颅gates or the Board of Gov颅er颅nors. No other member or em颅ploy颅ee may represent the Bar or a di颅vi颅sion, sec颅tion, com颅mit颅tee, board, task force, or com颅mis颅sion be颅fore a leg颅is颅la颅tive body, court or gov颅ern颅men颅tal agency, un颅less spe颅cif颅i颅cal颅ly au颅tho颅rized by the House of Del颅e颅gates or the Board of Gov颅er颅nors.

If rep颅re颅sen颅ta颅tion of the Bar requires the filing of a brief, it shall be re颅viewed by the Board of Gov颅er颅nors or its des颅ig颅nees and ap颅proved by the Board before it is filed.

Any member who, when making public ut颅ter颅ance, permits 颅the member to be iden颅ti颅fied as having an offi颅cial con颅nec颅tion with the Bar or one of its divisions, sec颅tions, com颅mit颅tees, boards, task forc颅es, or com颅mis颅sions shall, if the pol颅i颅cy of the Bar on the subject matter of the utterance has been de颅ter颅mined by the House of Del颅e颅gates or Board of Gov颅er颅nors, fairly state that pol颅i颅cy and, if the member ex颅press颅es views at vari颅ance with it, 91黑料爆料ar颅ly identify the vari颅ance as the member's per颅son颅al views only. If there has not been, or if the member has no knowl颅edge of, any such policy de颅ter颅mi颅na颅tion, the member shall nev颅er颅the颅less identify the member's ut颅ter颅ance as his per颅son颅al views.

The Bar shall indemnify each member of the House of Del颅e颅gates, member of the Board of Gov颅er颅nors, em颅ploy颅ee and agent who is or is threat颅ened to be made a party of any action, pro颅ceed颅ing or suit, wheth颅er ad颅min颅is颅tra颅tive, civil, crim颅i颅nal, or in颅ves颅ti颅ga颅tive (other than any action pro颅ceed颅ing by or in behalf of the Bar) by reason of the fact that the member is or was a member of the House of Del颅e颅gates, mem颅ber of the Board of Gov颅er颅nors, employ颅ee or agent of the Bar, or is or was serving at the request of the Bar in such ca颅pacity of the Bar, against ex颅pens颅es (in颅clud颅ing at颅tor颅neys鈥 fees), fines, judg颅ments, and amounts paid in set颅tle颅ment ac颅tu颅al颅ly and rea颅son颅ably incurred in con颅nec颅tion with any such action, pro颅ceed颅ing or suit if the individual acted in good faith and in a man颅ner the individual rea颅son颅ably be颅lieved to be in or not opposed to the best interests of the Bar and, with re颅spect to any crim颅i颅nal action or pro颅ceed颅ing, had no rea颅son颅able cause to believe the individual's con颅duct was un颅law颅ful.

The ter颅mi颅na颅tion of any such action, pro颅ceed颅ing or suit by 颅judgment, or颅der, set颅tle颅ment, con颅vic颅tion, or a plea of nolo contendere, or its equiv颅a颅lent, in and of itself, shall not cre颅ate a pre颅sump颅tion that the individual did not act in good faith and in a manner rea颅son颅ably believed to be in or not op颅posed to the best interests of the Bar, and, with respect to any 颅criminal action or pro颅ceed颅ing, had 颅reason颅able cause to be颅lieve the con颅duct was un颅law颅ful. In the dis颅cre颅tion of the Board, the Bar may make advanc颅es before fi颅nal dis颅po颅si颅tion of any such action, pro颅ceed颅ing or suit in respect of in颅dem颅ni颅fi颅ca颅tion.

The Bar may pur颅chase and main颅tain in颅sur颅ance on behalf of itself, mem颅bers of the House of Del颅e颅gates, mem颅bers of the Board of Gov颅er颅nors, em颅ploy颅ees and agents against li颅a颅bil颅i颅ty that may be as颅sert颅ed against it or against any such in颅di颅vid颅u颅al in such capac颅i颅ty aris颅ing out of their 颅status as such.

The officers of the Bar and the Immediate Past President shall con颅sti颅tute the Ex颅ec颅u颅tive Com颅mit颅tee. The Board of Gov颅er颅nors may em颅pow颅er the Ex颅ec颅u颅tive Com颅mit颅tee and other ad hoc com颅mit颅tees of the Board to act between meet颅ings of the Board. Any com颅mit颅tee ac颅tions must be rat颅i颅fied at the next meet颅ing of the full Board.

Any Board of Governors member may be removed from office for cause, as hereinafter defined, on the two-thirds affirmative vote of the membership of the Board present at a meeting called for that purpose. For purposes of this section, the term 鈥渃ause鈥濃坢eans any of the following:鈥

(a)鈥坱he member鈥檚 physical or mental illness rendering the member incapable of performing duties to the Bar for a period of more than three consecutive months;
(b)鈥坱he member鈥檚 absence at two consecutive Board meetings without cause deemed adequate by the Board;
(c)鈥坱he member鈥檚 continued neglect or failure, after written demand, to discharge duties or to obey a specific written directive from the Board;
(d)鈥坈onflicts which render the member incapable of fulfilling the member鈥檚 duties to the Bar;
(e)鈥坱he member鈥檚 engaging in adjudicated misconduct which is injurious to the Bar;
(f)鈥坱he member鈥檚 conviction of any felony or any crime involving moral turpitude;
(g)鈥坈onduct which would seriously impair the member鈥檚 ability to perform the member鈥檚 duties to the Bar. In the event of removal, the position will be filled in the manner outlined in the Constitution and Bylaws.

Arti91黑料爆料 VII. Finances

The Board of Governors shall for颅mu颅late and administer pol颅i颅cy respect颅ing ex颅pen颅di颅tures and pro颅ce颅dures for re颅im颅burse颅ment. If the pro颅pos颅al requir颅ing the ex颅pen颅di颅ture of funds origi颅nates in the House of Del颅e颅gates, it may be acted on only after the Board re颅ports on its fea颅si颅bil颅i颅ty.

(a) The Treasurer may pay only autho颅rized expenses that are within bud颅get ap颅pro颅pri颅a颅tions.
(b) Expenditures from section funds may be made only upon ap颅prov颅al of the Section chair.

The fi颅nan颅cial liability of the Bar to any sec颅tion, com颅mit颅tee, fund, or oth颅er orga颅ni颅za颅tion with颅in the Bar is lim颅it颅ed to the funds cred颅it颅ed to it on the fi颅nan颅cial records of the Bar and the liability ceas颅es upon the Trea颅sur颅er鈥檚 pay颅ment of that amount. If a section, com颅mit颅tee, fund, or or颅ga颅ni颅za颅tion, or one of its mem颅bers, incurs a liability that is great颅er than the funds so cred颅it颅ed, it is the ob颅li颅ga颅tion of each per颅son re颅spon颅si颅ble for in颅cur颅ring or au颅tho颅riz颅ing the li颅a颅bil颅i颅ty.

Arti91黑料爆料 VIII. Duties of Officers

The of颅fic颅ers of the Bar shall have the duties spec颅i颅fied below in addition to the du颅ties nor颅mal颅ly incident to their respec颅tive offic颅es.

The Pres颅i颅dent shall preside at all meet颅ings of the Assem颅bly and the Board of Gov颅er颅nors and shall appoint the chair颅 and members of all com颅mit颅tees, boards, task forces and commissions. The President shall be the of颅fi颅cial spokes颅man for the Bar and shall have gen颅er颅al charge and su颅per颅vi颅sion of its affairs sub颅ject to the au颅thor颅i颅ty of the House of Del颅e颅gates and Board of 颅Governors.

The Pres颅i颅dent-Elect shall perform such du颅ties as the Pres颅i颅dent may assign and, except as oth颅er颅wise provided, the du颅ties of the Pres颅i颅dent when the President is disabled from per颅form颅ing presidential duties or absent from any meet颅ing of the As颅sem颅bly, the House of Del颅e颅gates, or the Board of Gov颅er颅nors.

The Chair颅 of the House of Del颅e颅gates shall鈥
(a) preside at meetings of the House;
(b) preside, in the absence of the Pres颅i颅dent and the President-Elect, at meet颅ings of the As颅sem颅bly, and oth颅er meet颅ings at which the Pres颅i颅dent would pre颅side if he were present; and
(c) perform such other duties as shall be designated by the House of Del颅e颅gates.

The Sec颅re颅tary shall鈥
(a) keep the respective min颅utes and records of the As颅sem颅bly, the House of Del颅e颅gates, and the Board of Gov颅er颅nors;
(b) maintain the roster of the del颅e颅gates in the House;
(c) receive, certify, and publish nom颅ina颅tions of circuit delegates, of颅fic颅ers, and gov颅er颅nors;
(d) receive, certify, and publish the results of ballots;
(e) receive and maintain as the 颅proper颅ty of the Bar all papers, addresses, and re颅ports to the As颅sem颅bly, the House of Del颅e颅gates, and the Board of Gov颅ernors;
(f) give notice when notice is required to be given to the House of Delegates, the Board of Gov颅er颅nors, or the mem颅bers; and
(g) perform such other duties as shall be assigned to him by the Pres颅i颅dent or the Board of Gov颅er颅nors.

The Trea颅sur颅er shall supervise the safe颅keep颅ing of the funds and investments of the Bar and shall report periodically on its fi颅nan颅cial con颅di颅tion to the House of Del颅e颅gates and the Board of Gov颅er颅nors. The Treasurer shall per颅form such other duties as shall be as颅signed to him by the Pres颅i颅dent or the Board of Gov颅er颅nors.

Arti91黑料爆料 IX. Executive Director

The Board of Governors shall employ and super颅vise an Ex颅ec颅u颅tive Di颅rec颅tor who shall manage the ad颅min颅is颅tra颅tive and staff oper颅a颅tions of the Bar and whose term of employ颅ment shall be de颅ter颅mined by the Board.

Under the direc颅tion of the of颅fic颅ers and Board of Gov颅er颅nors, the Ex颅ec颅u颅tive Di颅rec颅tor shall im颅ple颅ment the policies of the Bar as deter颅mined by the Board of Gov颅er颅nors and House of Del颅e颅gates, and shall - 

(a) advise and assist the officers in 颅fulfill颅ing the re颅spon颅si颅bil颅i颅ties of their respec颅tive offices;
(b) report to the officers and the Board of Governors such matters as are nec颅es颅sary to keep them prop颅er颅ly informed of the ac颅tiv颅i颅ties and con颅di颅tion of the Bar;
(c) direct the preparation of and 颅partic颅i颅pate in the for颅mu颅la颅tion of the annual bud颅get for con颅sid颅er颅ation by the Board of Gov颅er颅nors and the House of Del颅e颅gates;
(d) provide staff and liaison sup颅port for all or颅ga颅ni颅za颅tions and func颅tions of the Bar;
(e) employ, determine the com颅pen颅sa颅tion of, train, supervise, as颅sign, man颅age, and discharge staff mem颅bers to carry on the work of the Bar within the 颅budget;
(f) manage and maintain the Bar quar颅ters and other prop颅er颅ty within the bud颅get; and
(g) perform such other specific du颅ties as may be directed by the Board of Gover颅nors.

Arti91黑料爆料 X. Divisions

The Young Law颅yers Division of the Bar shall con颅sist of all members of the Bar under the age of thirty-six years (36) and all new mem颅bers of the Bar thir颅ty-six years of age or over who have never been admit颅ted to prac颅tice in any oth颅er ju颅ris颅dic颅tion who shall be mem颅bers of the Di颅vi颅sion for five years fol颅low颅ing date of ad颅mis颅sion to prac颅tice in South Carolina. There shall be a Senior Lawyers Division which shall consist of all members of the Bar who are at least sixty (60) years of age.

The pur颅pos颅es of the Young Lawyers Di颅vi颅sion shall be to stimulate the interest of its mem颅bers in the objects of the Bar, to carry on ac颅tiv颅i颅ties which will be of as颅sis颅tance to its mem颅bers, and to make reports and rec颅om颅men颅da颅tions to the Board of Gov颅er颅nors. The pur颅pos颅es of the Senior Law颅yers Division shall be to stimulate the interest of its members in the activities of the Bar, to conduct programs of in颅ter颅est and val颅ue to its mem颅bers, and to conduct fo颅rums for dis颅cus颅sion among its mem颅bers.

The Young Law颅yers Division and the Senior Lawyers Division shall adopt by颅laws and may adopt amend颅ments there颅to which are not in颅con颅sis颅tent with the Con颅sti颅tu颅tion or these By颅laws and which shall become ef颅fec颅tive when ap颅proved by the House of Del颅e颅gates.

Arti91黑料爆料 XI. Sections

There shall be within the Bar such sec颅tions as the House of Del颅e颅gates may au颅tho颅rize, each of which shall consist of not fewer than 颅seventy members.

The mem颅bers of each section shall be mem颅bers of the Bar and meet such other require颅ments as the bylaws of the 颅section pro颅vide.

Each section shall have a chair颅. It may also have a chair-elect and such other of颅fic颅ers and coun颅cil as its bylaws may pro颅vide.

With the approv颅al of the House of Del颅e颅gates, sec颅tion mem颅bers may be required to pay dues. Sec颅tion funds shall be ad颅min颅is颅tered by the Trea颅sur颅er but shall be account颅ed for sep颅a颅rate颅ly from the gen颅er颅al fund. No section shall ac颅cu颅mu颅late an amount equal to more than five times its then current annual dues income. All funds in excess of such amount shall be trans颅ferred to the gen颅er颅al fund of the Bar.

Each sec颅tion shall meet during the year as the section may desire.

Each sec颅tion shall adopt bylaws and may adopt amend颅ments thereto which are not incon颅sis颅tent with the Con颅sti颅tu颅tion or these Bylaws and which shall be颅come ef颅fec颅tive when ap颅proved by the House of Del颅e颅gates. The ju颅ris颅dic颅tion of each sec颅tion shall be de颅scribed in its by颅laws.

Dur颅ing any year a section may be dis颅solved by vote of seventy percent of the section mem颅bers. In the event that any section does not have at least seventy mem颅bers by March 31 in any year that section will be con颅sid颅ered dis颅solved. Sec颅tion dues paid for the year in which dis颅so颅lu颅tion occurs shall be re颅turned to the mem颅bers. Re颅main颅ing funds shall be de颅pos颅it颅ed in the gen颅er颅al fund of the Bar.

The Board of Governors may from time to time cre颅ate com颅mit颅tees, boards, task forces and com颅mis颅sions with such as颅sign颅ments and duties as the Board shall specify.

Unless the res颅o颅lu颅tion or motion cre颅at颅ing the com颅mit颅tee, board or com颅mis颅sion pro颅vides oth颅er颅wise and ex颅cept as oth颅er颅wise provided in the Con颅sti颅tu颅tion and Bylaws (a) ap颅point颅ments to each com颅mit颅tee, board or com颅mis颅sion, includ颅ing the annu颅al appointment of its chair颅, shall be made by the Pres颅i颅dent; and (b) if a mem颅ber resigns, dies, or be颅comes in颅el颅i颅gi颅ble, the Pres颅i颅dent may ap颅point a suc颅ces颅sor for the 颅unexpired term.

The Board of Governors shall set the annual fee required for participation as a lawyer affiliate. Lawyer affiliates shall be afforded the same privileges as inactive members under Section 1.4.

The Board of Governors shall set the annual fee required for participation as a law student affiliate. A Law Student Affiliate Council shall be defined by the Board. The Council shall recommend to the Board the privileges to be afforded to Law Student Affiliates, with determination of those privileges reserved to the Board. The Council shall oversee all collective activities of the Law Student Affiliates.
